1. Respecting our service: FAIL
We Oppose a Probationary Period for Current Foxwoods Employees working on the MGM Side
The whole idea of a probationary period for current Foxwoods employees is an insult. Foxwoods says they want “terrific” employees for MGM. We are terrific dealers who are dedicated to Foxwoods. Our service and skills made the company vastly wealthy. How can they possibly treat us like new employees when we move to the MGM side?
MGM Toke Separation?
The Compact between the State and the Tribe allows only one casino facility with one gaming license.
So why is management talking about separating dealer tokes on the MGM side?
The tokes belong to dealers, not management. Dealers should control everything related to toke matters not management.
We expect that the opening of the MGM at Foxwoods will generate a lot of flash, a lot of hype, and an increase in tokes. Tokes should be shared equally by the new employees and those of us who worked hard to make MGM at Foxwoods possible.
2. Respecting our Rights: FAIL
In November, the National Labor Relations Board issued a Complaint charging Foxwoods with 25 violations of federal law. This month, the union filed four additional charges, including the illegal discharge of Dave Ellsworth. The N.L.R.B. will prosecute this case before an administrative law judge beginning March 25, 2008 on these charges.
3. Respecting Free Speech: FAIL
Foxwoods illegally fired Dave Ellsworth – for speaking the truth. He should immediately be reinstated with back pay plus interest.
Dave Ellsworth is a highly skilled 10-year dealer at Foxwoods. He has a clean employment record. Dave and his wife Lina own a home in Norwich. They have four children. Human resources knows that Lina, also a dealer, is out of work right now on disability leave.
Dave made a true statement to a coworker that one can go to jail for lying under oath. It is true: perjury is illegal. Witnesses at an NLRB hearing must swear to tell the truth. Why doesn’t management want you to know that you have to tell the truth? Don’t they believe in telling the truth? If management’s witnesses did not purposefully lie under oath, they should not be concerned. If witnesses felt coerced by management, they should contact our union office.
Foxwoods management does not respect our rights. This is yet another example of why we voted for a union. We are tired of management making all the decisions without employees having any recourse.
We will continue speaking up, speaking out and speaking the truth.
